What Is Kratom?
Kratom (Mitragyna speciosa Korth.) is an evergreen tree in the coffee family (Rubiaceae) that is native to Southeast Asia and cultivated especially in Indonesia, Malaysia, and Thailand for its historical medical and recreational uses.
Kratom is also referred to as biak-biak, ketum, or Maeng Da in different regions and describes both the tree and the varying extracts and preparations derived from it.2 The leaves of the tree, that are used for their pharmacological activity, can have different coloured veins (white, green, or red) which are not distinguished in its native habitat but have been attributed to varying effects when sold as powdered leaf extracts in Western countries.
The main active compounds of current interest are indole alkaloids, primarily mitragynine and 7-hydroxymitragynine that act as partial agonists on opioid receptors.
Kratom products contain approximately 2% mitragynine and either none or between 0.01% and 0.02% 7-hydroxymitragynine. Among other mitragyna indole alkaloids, mitragynine presents with a unique mechanism of action and pharmacology distinct from classical opioids like morphine, heroin, or fentanyl. Binding to the μ-opioid receptor causes recruitment and activation of the G-protein-coupled signaling cascade but does not lead to recruitment of β-arrestin 2 which has been associated with many of the undesired effects of opioid receptor activation such as constipation, respiratory depression, and dependence.
What Is Delta 8?
Delta 8 THC is a powerful cannabinoid derived from the cannabis flower but is found in smaller amounts compared to Delta 9. its psychotropic, well-known cannabinoid relative. The Delta 9 and Delta 8 THC are very similar, but the Delta 8 offers a potent high all its own. Our consumers of D8 THC report they experienced a nice body sensation and some in the head. Delta-9 THC is the potent THC you think of when people talk about THC and it’s a psychoactive compound that you can find in cannabis. It’s psychoactive once it’s activated with heat, that’s why when you smoke it you receive the psychoactive effects as well as medicine ones.
Delta-8-THC is similar and binds to the CB1 receptor that is found in the central nervous system. This is where you receive the medicinal help for symptoms stemming from nausea, pain, and anxiety.

It is used as a treatment for muscle pain, or to suppress appetite and stop cramps and diarrhea. Kratom is also sold as a treatment for panic attacks. Kratom is believed to act on opioid receptors. At low doses, kratom acts as a stimulant, making users feel more energetic.
Is Delta-8 Legal?
In most states, yes, Delta-8 is legal. There are 11 states that forbid it: Delaware, Alaska, Arizona, Arkansas, Colorado, Idaho, Iowa, Mississippi, Montana, Rhode Island, and Utah.
These companies place a leaflet into the boxes indicating why it is legal as per the 2018 Farm Bill in case packages are inspected by the government or the Postal Service.
Whether or not Delta-8 is legal in your state has nothing to do with actual cannabis legality. For example, cannabis is legal recreationally in Arizona and Colorado, but not Delta-8.
And every state has its own rules about Delta-8. Take Oregon, for example. They allow Delta-8 that was obtained from hemp involved in intrastate transfers, so long as it complies with the Oregon Dept. of Agriculture Laws and Rules, states VaporVanity. And yet, to be a Delta-8 seller, you must get permission from the Oregon Liquor Control Commission.

Kratom is legal, but may be regulated:
- Arizona – KCPA passed
- California – Outside San Diego, which banned it, kratom is legal in California
- Colorado – Outside Denver, where it’s considered illegal for human consumption, kratom is legal in Colorado
- Florida – Aside from being banned in Sarasota Country, kratom is legal in Florida
- Georgia – KCPA passed
- Illinois – Outside the city of Jerseyville, kratom is legal in Illinois for those over the age of 18
- Mississippi – Outside Union County, which has banned the substance, kratom is legal to use in Mississippi
- Nevada – KCPA passed
- New Hampshire – Kratom is legal for those over the age of 18
- New Jersey
- New Mexico
- New York
- North Carolina
- North Dakota
- South Carolina
- South Dakota
- Tennessee – Kratom is legal for those over the age of 21
- Utah – KCPA passed
- West Virginia
Is Kratom Legal in Other Countries?
Outside of the United States, kratom laws also vary. In the following countries, kratom is illegal:
- New Zealand (unless the person has a prescription from a doctor)
- South Korea
In countries like Ireland, Italy, and the United Kingdom, the rules may vary from one city to the next. It’s also important to note that the status of kratom legality isn’t widely known for some countries. For example, it isn’t clear whether it is legal in many African nations and China.
Additionally, Thailand has recently reconsidered the status of some illegal substances, so kratom might not remain illegal. However, as the drug becomes more widely known, countries, counties, and cities that don’t currently ban kratom may choose to do so at any point.
Kratom is a tree. The leaves are used as a recreational drug and as medicine. As a recreational drug, the leaves are chewed or drank as a tea to elevate mood (as a euphoriant) and enhance physical endurance.
